"Evrotrust Technologies" AD (the Company/Evrotrust/we) maintains and provides you with access to its information website – https://www.evrotrust.com (the Website), where information about us and the services we provide is available. Before continuing your visit, please read carefully this document which contains the terms of use of the Website (the Terms).

If you do not accept the Terms, you shall not use the Website. Use of the Website shall be deemed an expression of your consent to use it in strict compliance with the rules established in these Terms. These Terms do not apply to Evrotrust services for which there are separate rules (including our provision of authentication services), except in the cases where and to the extent that this is expressly provided for in the relevant rules. 

I. Who are we?

II. Services and Resources Available on the Website

The website aims to present the activities and services we provide, as well as to ensure compliance with the requirements necessary for our activities concerning the publication of certain documents, information and resources. The website contains various information resources and links to them, such as questions and answers about how to use our services, information resources of technical information, documentation required in connection with our obligations as a provider of qualified electronic authentication services, etc. The website also provides its visitors with the opportunity to make contact with us by filling in a relevant form to send an inquiry or make contact with us on various occasions.

Visitors to the Website who are Users of the electronic authentication services we provide through the Evrotrust application (the Application) may use the Website to log in and access their personal online portal (the Portal) to submit documents for signing through the Application and access and download the files submitted and signed. Through the Portal, Users can send documents for signing both to themselves and to one or more other Users of the Application, enable a requirement to review the document before signing, track the status of files, download them locally, etc.

The website also provides the opportunity to use the qualified authentication service called Qualified Validation of a Qualified Electronic Signature/Seal. The terms of use of this service are described in our General Terms and Conditions of the Agreement for Authentication, Information, Cryptographic and Other Services, which are available on the Website.‍

III. Intellectual Property and Content Reproduction

The intellectual property rights on all items and resources located on the Website, including, but not limited, to brands, logos, information materials and Website design, are subject to protection under the applicable law, are held by Evrotrust or the third parties designated accordingly and may not be used in violation of the applicable legislation.

The right to access the Website shall not include the right to copy, reproduce, store or transfer information or to use in any other unauthorized way objects of intellectual property, except in the case of information of minor volume intended for personal use, provided that the legitimate interests of the authors or other holders of intellectual property rights are not unduly damaged and in the event that the copying or reproduction is carried out for non-commercial purposes. Notwithstanding the above, it is not permitted to remove any trademark signs and designations of any other intellectual property rights from its accessible materials, regardless of whether the holder of the relevant rights is Evrotrust or a third party. Use of any content or other objects of intellectual property posted on the Website is permitted for personal, non-commercial purposes only. The use of such content for any other purposes may only be made subject to the express written permission of Evrotrust or the relevant third party.

IV. Links to other websites

For the purpose of providing information and for the convenience of visitors, references/links to websites administered by third parties may be published on the Website. The publication of such links shall not mean that Evrotrust endorses or agrees with the relevant content which the link leads to, nor that we endorse, recommend or promote the products and/or services described on the relevant webpage. Evrotrust shall not be responsible for the content and services available through those websites and accessing and using them shall be subject to their own terms of use. The Company shall not be liable for any damages suffered and lost profits arising from access to or use of such websites, nor for the unreliability of any content published on them.

V. Evrotrust Liability

We make sure that the information available on the Website is at all times kept up-to-date and provided in a quality, understandable and accessible way, however, we cannot guarantee the completeness of the content and do not commit to any deadlines for updating the information. We strive to provide visitors with a normal and trouble-free use of the Website. However, we reserve the right to interrupt or suspend functionalities of the Website and the services provided through it at any time, as well as to completely discontinue its maintenance and the access to it, without this leading to any liability for the Company. In addition, we reserve the right at any time to remove, amend or supplement the content published on and the services available through the Website.

Evrotrust shall not be liable for any damages that may be caused in connection with accessing or using the Website, unless they are caused by us intentionally or by gross negligence. Evrotrust shall not be liable for any damages caused to the software, hardware or facilities and equipment of visitors or for any loss of data resulting from materials or resources uploaded or used in any way through the Website.

Evrotrust shall not be under the obligation and does not guarantee that access to and use of the Website will be uninterrupted, timely, secure and error-free. The Company shall not be held responsible for the non-provision of access to the Website and the possibility of its use or for the provision thereof with a reduced quality as a result of tests carried out by us for the purpose of checking equipment, connections, networks and others, as well as tests aimed at improving or optimizing the functioning of the Website. Visitors accept the possibility of interruptions and other types of difficulties when making the Internet connection to the Website, which may occur regardless of our due care.

VI. Visitors’ Liability

Visitors undertake not to commit malicious acts when visiting and using the Website. "Malicious acts" means any actions or inactions violating Internet ethics or harming persons connected to the Internet or associated networks, sending unsolicited mail (unsolicited commercial messages, SPAM, JUNK MAIL), flooding channels (FLOOD) , gaining access to resources with foreign rights and passwords, using flaws in systems for one's own benefit or for obtaining information (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending "Trojan horses" or causing the installation of viruses or remote control systems, disrupting the normal operation of other Internet users and associated networks, performing any actions that may qualify as a crime or administrative offense under the Bulgarian legislation or under any other applicable law.

Visitors undertake to indemnify Evrotrust and any third parties for all damages and lost profits suffered by them, including for paid property sanctions, attorney's fees, litigation costs and other expenses, as a result of claims brought by and/or indemnities paid to third parties in connection with actions/inactions of visitors when using the Website in violation of the Bulgarian legislation, applicable foreign laws, these Terms or good morals.

VII. Personal Data Protection

In connection with the administration of the Website, we process personal data subject to the applicable legislation and in accordance with the rules and principles laid down in our Privacy Policy when using the Website and internet resources of Evrotrust Technologies AD (the Policy), published and available on the Website. The Policy shall form an integral part of these Terms.

VIII. Miscellaneous

These Terms shall be governed by the legislation of the Republic of Bulgaria. Any issues that remained unsettled in the Terms shall be governed by the provisions of the applicable legislation of the Republic of Bulgaria. The Terms may be amended at any time unilaterally by Evrotrust. When we make amendments to the Terms, we will bring those amendments to the attention of the visitors in accordance with the applicable law and by posting the amended Terms on the Website.

Any disputes between visitors to the Website and Evrotrust arising out of or relating to these Terms shall be resolved in a spirit of understanding and good faith by negotiation and mutual concessions. If it is impossible to reach an agreement, the dispute can be referred for resolution to the competent Bulgarian court based in Sofia City.

The Terms of Use of the website shall become effective from 01.01.2023.
